Terms of Sale

These terms apply to every purchase made on olshbau.art. Please read them before you place an order. If you are a consumer, nothing in these terms limits the rights you have under the law of your country.

1. Who we are

olshbau.art is run by:

Registered in the Central Register and Information on Economic Activity (CEIDG).

2. Definitions

  • Consumer: a natural person buying for purposes outside their trade, business or profession.
  • Sole trader with consumer rights: a natural person running a business who buys a work for a purpose that is not professional for them (for example, a doctor buying a relief for their home). Under Polish law you have the same withdrawal and returns rights as a consumer.
  • Work: an original artwork, a print or an object offered on olshbau.art.

3. The works

Each original work is made by hand and is unique. Photographs show the actual work, but screens differ in colour and scale. Please check the dimensions on the work page. Small irregularities in paper, plaster and wood are part of the making process and are not defects.

Dimensions are given as width × height × depth in centimetres. Hand-made pieces may differ from the stated size by a few millimetres.

Original works are signed and numbered by the artist on the back. Each original is shipped with a signed certificate of authenticity that carries the same number and a link to the work page on olshbau.art.

Photographic prints are made to order in the sizes and on the papers listed on the print page.

4. Orders and contract

  1. You place an order through the checkout on olshbau.art.
  2. We send an order confirmation by email. The contract is concluded when you receive this confirmation.
  3. Some works are also offered on other channels (for example, our Etsy shop). If a unique work sells elsewhere at the same moment, we will tell you within 2 business days, cancel the order and refund the full amount.

5. Prices and payment

  • Prices are shown in the currency displayed at checkout. Converted prices are indicative. You pay the amount shown at checkout.
  • The seller is exempt from VAT under art. 113(1) of the Polish VAT Act (zwolnienie podmiotowe). Prices do not include VAT.
  • Shipping to Europe, the United States and Canada is included in the price. For other destinations a flat shipping fee is added and shown at checkout before you pay (see Shipping).
  • For deliveries to the United States, we prepay import duties and customs fees. For other deliveries outside the European Union, import duties, local taxes and customs fees are charged by the destination country and paid by the buyer.
  • When we show a reduced price, we also show the lowest price of that work in the 30 days before the reduction.
  • Payment is taken at checkout by the methods shown there. Payments are processed by Shopify and its payment partners. We never see or store your full card details.

6. Delivery

7. Right of withdrawal and returns

Consumers, and sole traders with consumer rights, may withdraw from the contract within 14 days of receiving the work, without giving a reason. How to withdraw, costs and refunds are set out in our Returns policy, together with a model withdrawal form.

This right does not apply to commissioned works made to your individual specifications, as agreed with you in writing before the order.

8. Conformity of the work (complaints)

We are responsible to consumers for any lack of conformity of the work with the contract that becomes apparent within 2 years of delivery. If something is wrong, write to info@olshbau.art with a description and photos. We will reply within 14 days. Depending on the case, and as provided by law, we will repair or replace the work. If that is not possible, we will reduce the price or refund you.

9. Copyright

All works, images and texts on olshbau.art are protected by copyright, which remains with the artist. Buying a work transfers ownership of the physical object only, not the right to reproduce it. You are welcome to photograph the work in your home and share those photos for non-commercial purposes. Please credit OLSHBAU when you do.

10. Liability

We are liable in accordance with the law. Nothing in these terms excludes or limits our liability to consumers where the law does not allow it.

11. Personal data

How we handle your data is explained in our Privacy policy.

12. Law and disputes

These terms are governed by Polish law. If you are a consumer living in another country, you keep the protection of the mandatory rules of the law of your country of residence.

We try to resolve every issue directly, so please write to us first. Consumers in Poland may also use out-of-court help, such as a municipal or district consumer ombudsman (rzecznik konsumentów) or mediation at the Trade Inspection (Inspekcja Handlowa). Consumers in other EU countries can contact their national European Consumer Centre.

13. Changes

We may update these terms. The version published at the time of your order applies to that order.
